Federal Overtime Rules (FLSA)
Under the Fair Labor Standards Act (FLSA), non-exempt employees must receive overtime pay at 1.5 times their regular rate for all hours worked over 40 in a workweek.
Who Qualifies for Overtime?
- Non-exempt employees: Hourly workers and some salaried employees
- Salary threshold: Employees earning less than $58,656/year (2026) typically qualify
- Job duties test: Executive, administrative, and professional exemptions may apply
State-Specific Rules
- California: Daily overtime after 8 hours; double time after 12 hours
- Alaska: Daily overtime after 8 hours
- Nevada: Daily overtime after 8 hours (if making less than 1.5x minimum wage)
- Colorado: Daily overtime after 12 hours
