Understanding Overtime Pay

Federal Overtime Rules (FLSA)

Under the Fair Labor Standards Act (FLSA), non-exempt employees must receive overtime pay at 1.5 times their regular rate for all hours worked over 40 in a workweek.

Who Qualifies for Overtime?

  • Non-exempt employees: Hourly workers and some salaried employees
  • Salary threshold: Employees earning less than $58,656/year (2026) typically qualify
  • Job duties test: Executive, administrative, and professional exemptions may apply

State-Specific Rules

  • California: Daily overtime after 8 hours; double time after 12 hours
  • Alaska: Daily overtime after 8 hours
  • Nevada: Daily overtime after 8 hours (if making less than 1.5x minimum wage)
  • Colorado: Daily overtime after 12 hours
